3Privacy Policy

3.1 Who We Are

This Privacy Policy applies to learnwithsoleil.com (the “Site”), operated by Soleil Academy Of Languages LLC (“Soleil Academy,” “we,” “us,” or “our”), a Florida limited liability company providing in-home French tutoring services in Miami-Dade County, Florida.

3.2 Information We Collect

3.2(a) Information you provide directly

When a parent or legal guardian (“you”) requests a custom plan, books a session, or creates a Parent Portal account, we collect your name, email address, phone number, and billing or service address; your child’s name or nickname and age, collected only as needed to schedule age-appropriate sessions; and scheduling notes or preferences you provide.

3.2(b) Payment information

Payments are processed securely by Square. We do not store your full card number on our own servers. See Section 7, Payment Security.

3.2(c) Information collected automatically

Our Site uses Google Analytics to understand how visitors use the Site, including pages viewed, general region and device type, through cookies and similar technologies. Optional analytics remains disabled unless the visitor accepts it. This data is aggregated and is not used to build advertising profiles of children.

3.3 How We Use Your Information

We use information to schedule and deliver tutoring sessions; process payments and manage package or renewal status; communicate about accounts, sessions and service changes; respond to contact or custom-plan inquiries; protect and operate the service; comply with legal obligations; and improve the Site and services. We do not sell personal information to third parties.

3.4 How We Share Your Information

We share information only with service providers that need it to help us operate, including Square, Inc. for payment processing and Google for calendar scheduling and consented site analytics. These providers may use information only to provide their services. We may also disclose information if required by law or to protect the safety of a child, tutor or the public.

3.5 Children’s Privacy

Soleil Academy’s tutoring services are designed for children, but the Site and Parent Portal are directed to and used by parents and legal guardians. Adults provide all account and scheduling information on behalf of a child. We do not knowingly collect personal information directly from a child through the Site. If you believe a child submitted information directly, contact [email protected] and we will address the request.

3.6 Data Security

We follow the Florida Information Protection Act (Fla. Stat. § 501.171) and use reasonable administrative, technical and physical safeguards to protect personal information, and properly dispose of records that are no longer needed. No method of transmission or storage is 100% secure, and absolute security cannot be guaranteed.

3.7 Data Retention

We retain personal information for as long as necessary to provide services, comply with legal and tax obligations, resolve disputes and enforce agreements.

3.8 Your Choices and Rights

You may review, correct or request deletion of personal information held about you and your child by emailing [email protected] or using the privacy request form. You may opt out of promotional email through its unsubscribe link. This does not affect transactional messages about scheduled sessions, payments, account security or service changes.

3.9 Changes to This Policy

We may update this Privacy Policy. The Effective Date reflects the most recent revision; material changes will be posted on this page.

4Terms and Conditions

4.1 Acceptance of Terms

By booking a session, purchasing a package, or clicking “I agree” on the Site or in the Parent Portal, you, as parent or legal guardian, confirm that you have read, understood and accepted these Terms on your own behalf and on behalf of your child. Electronic acceptance is valid and binding under the federal E-SIGN Act and the Florida Uniform Electronic Transaction Act (Fla. Stat. § 668.50).

4.2 Description of Services

Soleil Academy Of Languages LLC provides in-home French tutoring and language instruction for children at the address you designate within our service area in Miami-Dade County, Florida. Sessions are scheduled through the Parent Portal and delivered by tutors assigned by Soleil Academy.

4.3 Booking and Payment

Services are purchased as prepaid hour packages. Full payment is due at purchase and is processed securely by Square. Package hours are valid for 120 days from the purchase date unless otherwise expressly stated at checkout.

4.4 Automatic Renewal

At checkout, you may enable automatic renewal or choose manual renewal. Before automatic renewal, we disclose renewal price, frequency and cancellation method. Automatic renewal requires affirmative action and is never enabled by default. You may cancel before the next renewal through the Parent Portal or by contacting [email protected], using a process no more difficult than enrollment. Manual renewal authorizes no future charge without a new purchase.

4.5 Rescheduling, No-Shows and Refunds

4.5.1 Rescheduling with notice

You may reschedule any session at no cost, with no limit on the number of times, provided you notify us more than 24 hours before the scheduled session.

4.5.2 Less than 24 hours’ notice, or no notice

If a session is not rescheduled at least 24 hours in advance, the assigned tutor will still travel to your home at the scheduled time.

4.5.2(a) Arrival window

Due to traffic, the tutor may arrive up to 15 minutes before or after the scheduled start. Paid session time is counted from actual arrival at your door, not the originally scheduled time, so arrival within this window does not shorten the session.

4.5.2(b) 30-minute wait

If no one answers, the tutor waits at the location for up to 30 minutes from the scheduled start. If the session has not begun by the end of that window, it is cancelled and forfeited, counted as used and charged in full without refund or credit.

If someone answers and the session begins before the 30 minutes have elapsed, the session generally runs for its full paid length. If another session is scheduled immediately afterward that day, waiting time is deducted because the tutor must leave on time to reach the next family. If no session follows, the tutor may extend the session to deliver its full paid length despite the late start.

4.5.3 Exceptions

Unusual circumstances may be discussed directly with Arlenis. Exceptions may be made at her discretion, depending on scheduling availability.

4.5.4 Refunds

Prepaid package hours are non-refundable in cash. Sessions may be rescheduled under Section 4.5.1. Hours not rescheduled at least 24 hours in advance, or for which you did not otherwise notify us or reach Arlenis directly, are handled under Section 4.5.2.

4.6 Sessions in Your Home

You are responsible for providing a reasonably safe environment, ensuring a responsible adult is present during the child’s session unless otherwise agreed in advance, and informing us of relevant safety, health or access considerations. Soleil Academy is not a licensed childcare or daycare provider; tutors are not a substitute for parental or guardian supervision.

4.7 Limitation of Liability

To the maximum extent permitted by Florida law, Soleil Academy’s liability for a claim arising from services is limited to the amount paid for the specific sessions at issue. Nothing limits liability for gross negligence, willful misconduct or a claim that cannot be limited or waived under Florida law, including claims brought on behalf of a minor.

4.8 Photos and Testimonials

By accepting these Terms at enrollment, you provide written consent for Soleil Academy to photograph or video-record tutoring sessions as described in Section 8. Recording is not permission to publish. Every specific item showing your home, child, you or another non-Soleil person requires the separate text-message approval described in Section 8 before publication. Testimonials are governed by Section 5.

4.9 Governing Law and Venue

These Terms are governed by Florida law without regard to conflict-of-law principles. A dispute not resolved informally shall be brought in the state or federal courts located in Miami-Dade County, Florida.

4.10 Changes to These Terms

We may update these Terms. Continued use after an update constitutes acceptance of revised Terms. Material changes affecting active packages will be communicated directly.

5Reviews & Testimonials Disclosure

5.1 Genuine experiences

Reviews and testimonials published on this website and in marketing materials reflect genuine experiences of actual Soleil Academy clients, shared in their own words. We do not create, purchase or fabricate reviews, and do not publish testimonials from anyone who has not personally received services.

5.2 No review incentives

We do not offer discounts, credits or incentives for leaving a review. After a child completes at least three sessions, we may email the parent an invitation to share an experience. Invitations are sent broadly and are not limited to families we believe are satisfied.

5.3 Negative experiences and reviewer control

If a review reflects a negative experience, we may contact the parent to understand and try to resolve it. If the parent independently decides to update the review, they may do so. We do not compensate or incentivize a change and do not delete, edit or alter reviews ourselves. Only the reviewer may modify or remove their review. Each parent may submit one review.

5.4 Featured reviews

We may choose which reviews to feature and may shorten excerpts for length, but do not alter substantive meaning or misrepresent the overall balance of feedback received.

5.5 Media incentives

Families participating in the Photo & Video Media Policy may receive a personalized discount for media use, not for reviews. If incentivized media is published with a parent quote, review or endorsement, we disclose that the parent received an incentive.

5.6 Freedom to review

Nothing in these Terms or another agreement restricts, penalizes or discourages an honest review on this website or elsewhere, consistent with the Consumer Review Fairness Act (15 U.S.C. § 45b).

6Tutor Qualifications

6.1 Training and certifications

Arlenis Ortega has completed the Florida Department of Children and Families 40-Hour Child Care Training and holds CPR and First Aid certification. These credentials support child safety and care awareness in her work with young learners.

6.2 Scope of the statement

These qualifications are presented by their specific names. Soleil Academy does not represent them as a separate French-language teaching license or guarantee a particular educational outcome.

7Payment Security

7.1 Square processing

Payments on this website are processed through Square, Inc. (“Square”), a PCI DSS Level 1 certified payment processor. Card information is encrypted and tokenized by Square at the point of entry.

7.2 Card information

Soleil Academy Of Languages LLC does not receive, store or have access to your full card number, CVV or other sensitive card-authentication data on its own systems. We retain only information available through the transaction record that is necessary for recordkeeping and customer service, such as payment status, amount, date, receipt information and limited card details supplied by Square.

7.3 Square responsibility

Storage, processing and transmission of card data are handled by Square. Square is responsible for security of that data in transit and at rest. For more information, visit Square’s Trust Center.

8Photo & Video Media Policy

8.1 Stage 1 — Consent to Record

When you enroll and accept the Terms, you give Soleil Academy written consent to photograph or video-record tutoring sessions, including content generated in your home involving your child or you as a parent or guardian present at the session.

8.2 Stage 2 — Approval Before Publishing

Recording is not the same as publishing. Before we publish a specific photo or video showing your home, child, you or anyone who is not Soleil Academy personnel, we send that specific content to you and request approval by text message. Content is published only after you reply to approve it.

8.3 Published content

Once content is approved and published, it becomes part of Soleil Academy’s social media presence and is owned by Soleil Academy Of Languages LLC. Except in exceptional circumstances reviewed at Soleil Academy’s discretion, published content is not removed after the fact because approval is given and acted upon at publication. Parents who prefer not to participate in some or all content may say so at any time without affecting enrollment or tutoring services.

8.4 Protection of children’s information

In public use, a child is identified at most by first name. We do not publish a child’s surname, date of birth, exact age, school or home address with a photo or video.

8.5 Personalized incentives

Personalized incentives may be available to participating families. They are discussed individually with administration and are not offered at a fixed published rate. If incentivized media appears with a review, quote or endorsement, the connection is disclosed.

9Discounts & Promotions

9.1 Media Participation Incentive

Soleil Academy may offer a personalized discount or promotional offer to families participating in Section 8. Offers are not published at a fixed rate and are discussed and agreed individually with administration.

9.2 Loyalty Incentive

Families enrolled for more than one year may contact administration to discuss a personalized loyalty offer. These offers are individualized and not published at a fixed rate.

9.3 Discretion and other rights

A discount or promotional offer is provided at Soleil Academy’s discretion, may vary by family and does not affect rights and policies described elsewhere in this Legal Center.

10Right to Decline or Discontinue Service

10.1 Non-discrimination

Soleil Academy is committed to serving families of every background. We do not discriminate on the basis of race, color, religion, national origin, sex, sexual orientation, gender identity, disability, immigration or documentation status, or any other characteristic. We decline a working relationship only based on conduct and the safety and respect conditions below.

10.2 Declining future bookings

After a package’s hours are completed, Soleil Academy may decline additional hours when the assigned tutor determines that minimum conditions necessary to safely and effectively deliver tutoring were not met, or the relationship was not conducted on safe or respectful terms. This concerns safety and working conditions, not disagreement about session quality. Service concerns may be raised under Section 4.5.3.

10.3 Immediate termination

If a family engages in conduct toward a tutor that is offensive, demeaning, harassing, threatening, racist or otherwise makes a tutor feel unsafe or disrespected, Soleil Academy may immediately end the tutoring relationship. In that case, we refund the prorated value of paid, unused session hours.
